Likelihood of Confusion? Inside the Latest Taylor Swift Trademark Dispute

Recently, news broke that Taylor Swift’s lawyers have filed a Notice of Opposition against another mark.

A bedding company, “Swift Home” has attempted to register its name as a Trademark. However, according to Taylor’s attorneys, the mark is too similar to hers. While the names may appear different at first glance, much of the discussion centers on the style of the mark, not just the wording itself. That may be where the applicant went wrong.

It is also worth noting that the application made it to publication, meaning a United States Patent and Trademark Office examining attorney did not initially find the marks confusingly similar. Yet Taylor’s legal team did. And as an owner of a mark, they have every right to raise that challenge.

So the real question becomes, are consumers likely to be confused between these two marks?
